my soon to be exhusband is on the mortgage and i am on the property deed. He said that he is removing me off the deed and listing the house for sale. MY question is how can he removed me off the deed without buying me out and listing the property without my signature on the listing agreement? tThis has been a very stressful time for me and my family and I am not sure where I stand at this point with my rights.

I LOAN A PERSON 15K(DID THIS IN A MORTGAGE) TO PURCHASE A PROPERTY THIS PERSON ALSO TOOK A LOAN OUT WITH THE BANK TO PURCHASE THIS SAME PROPERTY FROM THE SELLER. I RECORDED MY MORTGAGE BEFORE THE BANKS. THE COUNTY RECORDS SAY THAT I HAVE 1ST PRORITY, THE BANKS CLAIM THAT EVEN THOUGH IM LISTED AS 1ST SINCE THEY ARE A PURCHASE MONEY MORTGAGE THEY ARE 1ST. I SAID THAT IM A PURCHASE MONEY MORTGAGE TO. THE TITLE COMPANY SEND ME A SUBORDINATION AGREEMENT WANTING TO PAY ME $1000 IF I SIGN, IF I DON'T THEY SAID THEY WILL GO INTO LITIGATION. We had co-signed a mortgage on a mobile home, the other party quit paying about seven years ago, so we had to pay the mortgage on it all of this time. We have a home which we own and sometimes it is hard paying both mortgages. It is not being rented out at the present time. Someone told us just to let the bank reposes it. Cant this ruin our credit? and cant they go after the home in which we reside?

The home I live in has my ex-husband only as the person whose name is on mortgage. However, for the last ten years I have paid the mortgage myself, the deed of the house has only my name on it, not my husband\'s as he deeded it to me ten years ago. My company is transferring me, and will purchase my current home if we can't sell it. Our credit score in in the 500's due to an illness that caused my husband to lose his job. We have two late mortgage payments from 8 months ago - which surprised me because I contacted the mortgage company and they agreed to those late payments before they were late. We also have several other late payments, one 5 months ago, but most are about 10 - 12 months and everything current since then. I have worked for this company for more than 15 years and my spouse recently was approved for disability payments which has helped. We have never had a judgement filed against us or filed bankruptcy, and all our accounts are current. I was sick to see my credit score so low. In this new strict housing market is there any chance that we might get a mortgage? We should get enough out of the sale of our current home to put 20% down. I am very worried about even being able to find a place that with rent to us with such a crummy credit score. Thanks, I appreciate your advice.

My husband and I have lived in our home for 5 years. We have never been late on our mortgage and refinanced and obtained a 2nd mortgage. Currently our 1st mortgage is 345,000 and 2nd is 80,000. My husband is being relocated with his job and we have to sell the house because they are moving us out of state. I know that our home is worth about 350,000 to 360,000. My lawyer says I can get a court order to get him out, but if I sell the house, we would split the profit. I'm getting married. My fiance owns his own home. The mortgage and deed are both in his name. He owes about 75% of the value of the home on the loan. We want to get a Home Equity, with me as the primary, for a better interest rate. Can he just add me to the deed? Does the primary mortgage holder have to OK me being added to the deed since I'm not on the mortgage? Also, if I need to be on the primary mortgage, can I just be added to the mortgage without having to refinance the primary loan?? Note: the primary mortgage has a great interest rate, so I don't want to refinance it. Also, I have excellent credit and have already been preapproved elsewhere for well over the mortgage balance.

we used to have a very good loan discount on our mortgage at the bank where she used to work.I am on disability and over the past 4-5 yrs. have been renovating our home.I have almost doubled its value.However my wife has a health condition since birth called syringual mieliea.her condition took a turn for the worse and she had to stop working.thus we have lost our discount mortgage rate and her long and short term disability benefits have been denied.we have retained an attorney but have only limited savings from a cashed out 401 K.are there any programs available other than bankruptcy that we could qualify for so that we could get a reduced rate on our mortgage even though we are not employed.we would like to avoid being a further burden on the state as well as keep our modest little home that we have put so much hard work into. please help. thank you, Tim and Denise Norris
