My husband got a construction loan to buy a piece of land, co-signed by his grandfather. My name is NOT on the deed, but I was told to sign the Mortgage. What responsibilities and liabilities does this put on me if something happens to my mariage, or (God forbid) my husband dies?

My finace's mother has a very peculiar problem. Her and her husbands finances have always been seperate. They own three houses and have a small mortgage on the one they live in, the other two are rentals. He is very tight with his funds, she has helped out her family and children to the poibt were she has become over extended in credit card debt and other financial obligations she can no longer afford. He will not help her. He will not sign for any type of credit line or loan. Being that California is a community property state, and she contributed just as much to their wealth, is there any way she can get a line of credit, or loan using either one of the properties or her primary residence without him? Divorced has been discussed, in which case it wouldn't be a problem, and I realize that community property states require lenders to have both signatures, but is there any loophole, law, or back door she could use to go forward without him? Any information you could give me would be helpfull.

This might seem a little strange, however I would like to know if there is a way to remove my name from our mortgage? It is a VA loan and no I am not getting divorced. My husband is always late for at least the last 3 years and my credit report is being distroyed by this. I am not a person who is ever late on bills. Is there anything I can do?

My husband and I own a property in Vermont that we have not lived in since 1999. We moved to California, and rent a condo here. Our adult children lived in the VT home for 3 years and they rented rooms to their friends (we received the rent). Since then we have been renting it to tenants. We have refinanced it since we moved to CA. Now we are considering refinancing again - the loan company is in Florida (located by us on the internet). They have discussed with my husband that it would be a better loan if we call the VT property our primary residence or possibly a 2nd residence. I am concerned that they are trying to convince us to do something illegal. Am I right?

My husband and I are separating and he does not want to have anything to do with the house or mortgage and wants his name removed. My brother would like to move in and share ownership of the house. Can we just add or remove people from the Mortgage. Of couse all monies have been negotiated and agreed upon, just not sure if you can change ownership name or you have to start again. I have a good rate until 2009, so I do not want to renegotiate at this time, just change owership of Mortgage. Thanks

In 1999, my husband and I purchased a home. When the 9-11 attacks happened we refinanced our home from a thirty year to a fifteen year mortgage to get a lower and fixed interest rate. Due to my low credit rating, my spouse said the lawyer suggested he have me sign a document that would take me off the mortgage so only my spouse's credit rating would be a factor. I am now, after fifteeen years of marriage, and five children, going through an ugly divorce and my spouse is trying to use this document to dispute the community property law in the state of Louisiana, so that he may gain the house which I was awarded due to minor children still in the home. We currently owe 50,000 and it is valued at about 85,000. To keep from having to split the value of the equity in our home with me, he is now using this document to stop me from benefiting in any way. I need to know the name of the type of document they had me sign, and what if any rights I have according to LA laws. Thank you.

My husband and I are separating, and I want to purchase the property that we now own jointly. In essence, I would like to buy him out by taking a home loan to pay off the existing mortgage plus enough to cover his share of the equity in the house. Would this be considered a refinance in my name only, or is it an actual purchase where I have to come up with a down payment, etc. I'm just graduating from medical school this May with a firm job offer, but my personal savings after 10 years of school don't amount to much. Thank you.
