my house loan is currently in my dads name. Is it possible to refinance the mortgage into my & my husbands name? Or even to add my name on the mortgage so that if my dads credit situation changes i don't have a lien put on my house. He currently has another house in his name also.

Probably a stupid question. I've begun the process of buying my first home, and from my dad, I've heard that I'll get the equity check pretty much at the closing on the house, and then someone else told me no, it only happens if I refinance. Who's right? And is it different for every state, or the same? I'm so confused! (Lest anyone thinks I'm being greedy, I'm not; it'd be nice to have that equity money, but it's just the icing on the cake.)

I financed a piece of property from the owner. I am now paying it off. I have a Warranty Deed With Vendor's Lien filed at the court house. At the end of the contract it states; "The vendor's lien against and superior title to the property are retained until each not described is fully paid according to its terms, at which time this deed shall become absolute." What papers do He and I need to sign to conclude this transaction so that I can file it at the Court House?

My finace's mother has a very peculiar problem. Her and her husbands finances have always been seperate. They own three houses and have a small mortgage on the one they live in, the other two are rentals. He is very tight with his funds, she has helped out her family and children to the poibt were she has become over extended in credit card debt and other financial obligations she can no longer afford. He will not help her. He will not sign for any type of credit line or loan. Being that California is a community property state, and she contributed just as much to their wealth, is there any way she can get a line of credit, or loan using either one of the properties or her primary residence without him? Divorced has been discussed, in which case it wouldn't be a problem, and I realize that community property states require lenders to have both signatures, but is there any loophole, law, or back door she could use to go forward without him? Any information you could give me would be helpfull.

I have a primary mortgage with Citifinancial. They are willing to take the house back as a deed in lue of foreclosure. I have a second mortgage with HFC - Express Equity Loan. What happens to the 2nd mortgage? I filed chapter 7 bankruptcy in Sept. 2005 and it was discharged in December 2005. The house was fully "encumbered" as a result.

I just moved back to Illinois. I own a house in AZ that I bought but couldn't afford the payments and got a letter threatening forclosure so I moved home. I am living with my parents and have no money. I do have a car that is payed for but really no other debt. The house in AZ has 2 mortgages. What happens from here? I am renting a single family home. The owner lives in another state and has decided that he can no longer carry the mortgage as he is charging me less rent than he pays out monthly on the property. He says to stop paying him rent as he is going into foreclosure and will negotiate with the mortgage holder (holders?) to try and sell short and get me into the ownership of this house. I have zero money down but could pay closing and have an excellent credit rating/history and both my wife and I have scores from the mid to high 700's. Should I bail out or try to fing the mortgage holder (how?) to negotiate a deal?
